Terms And Condition

1. Conclusion of the Travel Contract

Please note, that your booking at Panorama Cilento Reisen will be binding as far as you will have receipt the booking confirmation / invoice from our reservation office in Kempen / Germany.

2. Condition of Payment

Please transfer the advance payment in the amount of € 200,-- within 2 weeks after receipt of the booking confirmation to our account Nr. 179452, KSK Köln, bank code (BLZ) 370 502 99. The balance has either to be transferred to our account in Germany prior departure or locally in Italy by cash payment.

 

3. Our Services

The extent of our contractual services is described in our brochure, on our Internet page as well as in your booking form sheet, which will also be confirmed in our telephone conversation. Additional agreements which change the extent of our services have to be confirmed in written form.

4. Changes of Services and Prices

Changes or deviations of individual travel services of agreed upon contents of the travel contract, which become necessary after conclusion of a contract and which were not caused by us against faithful and faith, are only permitted, as far as the changes or deviations are not substantial and do not impair the total cut of the journey. Possible warranty claims remain unaffected, as far as the changed achievements are afflicted with lack. We are obligated to inform you immediately over changes of achievement or deviations. Price adjustments are possible after conclusion of the travel contract for essentially entitled, substantial or unforeseeable reasons to the extent, how the material reasons justify the extent of the price adjustment, if between the receipts of the travel confirmation and the travel start are more than four months. If this should be the case, you will be informed immediately, but three weeks before travel start at the latest. Prices increases thereafter are not permissible. If the price increase will be over more than 5 % of the travel price you are justified to resign form the journey free of charge within 10 days.

 

5. Withdrawal by the guest, Transfer Posting, Replacement by third

You can withdraw from the journey at any time before travel start. The receipt of the written declaration of withdrawal is relevant with us. We recommend to you urgently to explain the resignation in writing. If you withdraw from the travel contract or if you do not start the journey, we can require appropriate replacement for the met travel precautions or expenditures. With the computation of the replacement the usually served expenditures and usual possible other one use of the cruising power outputs are considered by us. The height depends on the travel price. The resignation lump sums amount is follows:

 

until   45  days before travel start                      10 % of the travel price, but minimum € 50,--.
from 44th until 30th day before travel start           30 % of the travel price
from 29th until 14th day before travel start           50 % of the travel price
form 13th until 7th   day before travel start           60 % of the travel price
from   6th until departure day                             80 % of the travel price

With non appearance the entire travel price without deduction is due. It is open to you to prove that actually smaller or no costs than the validity made resignation lump sum developed for us. Transfer posting desires of the travel guest can be made. Developing extra costs are charged to you. You are able to assign replacement by third to go on journey, as far as the person corresponds to the travel requirements. In this case we raise a handling charge from € 25,---.

 

6. Travel cancellation insurance

Each journey starting from € 300,-- travel price contains a travel cancellation insurance automatically. Under certain conditions the insurance covers also the cancellation costs (less retention). The insurance document of identification with complete conditions of insurance will be despatched to you together with the booking confirmation.

7. Required services not taken

If you do not take services due to premature return journey or for other compelling reasons, then no reimbursement will take place via us.

8. Withdrawal and Cancellation by the Travel Business

If the travel guest disturbs the execution of the journey lastingly and regardless of a warning by us or behaves in such measure contrary to the terms of the agreement, we are able to cancel the travel contract without adherence to the cancellation period. If the minimum number of participants is not reached, we are entitled to call off the journey for weeks before travel start at the latest. We will then return to you the deposited travel price immediately.

9. Responsibility of the Travel Business

We are responsible in the context of the duty to exercise diligence of a scrupulous merchant for the conscientious travel preparation and travel completion, the careful selection and monitoring of the service providers, the correctness of the service descriptions and the proper contribution of the contractually agreed travel services.

 

10. Warranty

If the journey is not furnished as agreed upon, then the travel guest can require remedy. The travel business can refuse the remedy, if it requires a disproportionate expenditure. The travel business can also create remedy in the way that it furnishes and equivalent indemnification. For the duration of a not stipulated contribution of the journey, the travel guest can require an appropriate reduction of the travel price (decrease). The decrease does not occur, if the travel guest omits culpably to indicate the lack. If a journey is substantially impaired due to a lack and if the travel business does not carry out remedy within an appropriate period, then the travel guest is allowed to cancel the travel contract within the context of the legal regulations. The same applies, if the journey can not be tolerated by the travel guest due to substantial and noticeable reasons. The regulation only does not require a period for the remedy if the remedy is impossible or is refused by the travel business or if the immediate notice of the contract is justified by a special interest of the travel guest. If the travel business has to represent a circumstance, which leads to a lack of the journey, the travel guest can require compensation.

 

11. Obligation to Co-Operate

The travel guest is obligated to participate in the context of the legal regulations to avoid or keep possible damage small, especially if service lacks are arisen. The traveler is in particular obligated to give immediately information of the objections to the local coworkers. They are assigned to provide for remedy if this is possible. If the travel guest omits culpably to indicate a lack, then a claim does not occur.

12. Exclusions of Claims

The travel guest is obligated to raise the claim because of not stipulated contribution within one month after contractually completion of the journey to the travel business.

 

13. Court of Jurisdiction
